Terms of Use
These Terms govern your use of the RepCap mobile application, website, and related services. By using RepCap, you agree to these Terms.
1. The service
RepCap is a camera-assisted workout tool that can recognize supported exercise positions, count repetitions, follow the Cindy workout sequence, record workouts, and present workout statistics. Features may differ by device, operating system, region, or purchase status.
2. Eligibility
You must be legally able to agree to these Terms. If you are not old enough to do so independently in your country, a parent or legal guardian must review and accept these Terms and supervise your use.
3. Exercise safety
Physical exercise carries risks, including falls, overexertion, equipment failure, and serious injury. Before training, make sure you have appropriate health clearance, suitable equipment, enough space, and a safe camera position. Stop immediately if you feel pain, dizziness, unusual shortness of breath, or other concerning symptoms.
RepCap is not medical advice, diagnosis, treatment, coaching, or emergency assistance. Consult a qualified medical or fitness professional when appropriate. Do not rely on RepCap to determine whether an exercise is safe or suitable for you.
4. Tracking accuracy
Camera angle, lighting, clothing, visibility, exercise technique, device performance, and other conditions can affect recognition. Rep counts, timing, calorie estimates, pose feedback, and other statistics may be incomplete or inaccurate. You remain responsible for your workout decisions and form.
5. Camera placement and surroundings
Secure your phone before starting. Do not place it where it could fall, be struck, block a walkway, distract you, or expose another person without permission. RepCap is not responsible for damage caused by unsafe device placement or workout conditions.
6. Recordings and your content
You retain rights in recordings you create. You are responsible for having permission to record other people and for complying with local privacy and recording laws. When you save or share content through another service, that service's terms and privacy practices apply.
7. Purchases and subscriptions
Some features may require a monthly or annual subscription or a lifetime purchase. Prices and available products are shown before purchase. Subscriptions automatically renew unless cancelled through your Apple App Store or Google Play account before the applicable renewal deadline. A lifetime purchase unlocks the covered features for the store account used to purchase it, subject to continued service availability.
Apple or Google processes payment, renewal, cancellation, and refund requests under the applicable store terms. Use “Restore purchases” in RepCap when moving to an eligible device using the same store account.
8. Acceptable use
You may use RepCap for personal, lawful purposes. You may not interfere with the service, bypass purchase controls, reverse engineer it except where law expressly permits, distribute a modified copy, use it to violate another person's rights, or use automated means to abuse the website or supporting services.
9. Intellectual property
RepCap and its software, visual design, text, branding, and original content are protected by intellectual-property laws. These Terms grant you a limited, personal, non-exclusive, non-transferable, revocable right to use the service as intended. They do not transfer ownership of RepCap intellectual property.
10. Third-party services
RepCap may rely on operating-system services, app stores, RevenueCat, pose-detection technology, Cloudflare, Google Analytics, and sharing destinations. We do not control those services and are not responsible for their independent availability, terms, or practices.
11. Privacy
Our Privacy Policy explains how information is handled. By using RepCap, you acknowledge those practices.
12. Changes and availability
We may add, change, suspend, or discontinue features and may update these Terms. We will identify updated Terms by changing the effective date and provide additional notice when legally required. Continued use after an update takes effect means you accept the revised Terms.
13. Disclaimer
To the maximum extent permitted by law, RepCap is provided “as is” and “as available.” We disclaim implied warranties of merchantability, fitness for a particular purpose, accuracy, availability, and non-infringement. Mandatory consumer warranties that cannot legally be excluded remain unaffected.
14. Limitation of liability
To the maximum extent permitted by law, RepCap and its operator will not be liable for indirect, incidental, special, consequential, or punitive damages, loss of data, lost profits, personal injury arising from unsafe exercise decisions, or device damage. Nothing in these Terms excludes liability that cannot legally be limited, including applicable mandatory consumer rights.
15. Ending use
You may stop using RepCap at any time and remove it from your device. Store subscriptions must be cancelled through the relevant store. We may restrict access when reasonably necessary to protect the service, enforce these Terms, or comply with law.
16. Governing rules
These Terms are governed by the laws applicable where the RepCap operator is established, without limiting mandatory consumer protections or dispute rights available in your country. Before starting a formal dispute, please contact us so we can try to resolve the issue.
